1. General Policy

   At Touch of Boudoir by Bright Shot Studios LLC, we aim to provide an exceptional photography experience. Due to the personalized and time-sensitive nature of our services, we have established the following refund policy to ensure clarity and fairness for all parties involved.

2. Non-Refundable Retainer

   • Session Fee as Retainer: The Client agrees to pay Touch of Boudoir a non-refundable session fee of $395 at the time of booking. This Retainer secures the reservation of the date and services provided by Touch of Boudoir and its subcontractors, including makeup artists and hairstylists. The Retainer is credited towards the total cost of the Client's chosen photography package.

   • Forfeiture upon Cancellation: In the event of cancellation by the Client, the Retainer is forfeited as liquidated damages to compensate Touch of Boudoir and its subcontractors for their inability to rebook the reserved date. This provision is intended to provide reasonable compensation due to the logistical and financial impacts of a canceled booking.

3. Rescheduling Policy

   • Notice Requirement: The Client must notify Touch of Boudoir immediately of any changes in schedule or location at least two weeks prior to the scheduled date of the event. Rescheduling within 14 days of the event incurs a $250 rescheduling fee.

   • COVID-19 Provisions: In light of COVID-19, cancellations due to client illness must be supported by a positive COVID-19 test result. Under such circumstances, the event may be rescheduled to a mutually agreeable date without penalty, subject to the availability of Touch of Boudoir and its subcontractors.

4. Cancellation by Studio

   • Studio-Initiated Cancellations: In the rare event that Touch of Boudoir by Bright Shot Studios LLC must cancel your session, you will receive a full refund of all fees paid, or you may choose to reschedule your session at no additional cost.

   • Force Majeure: If Touch of Boudoir cannot perform this agreement due to a fire, casualty, strike, or other acts of God, or further conditions as outlined in section 18 of the contract, then Touch of Boudoir shall return any moneys paid by the Client, less expenses incurred and the non-refundable retainer fee, but shall have no further liability with respect to the agreement.

5. Product and Service Refunds

   • Digital Products: Due to the digital nature of our photography services, all sales of digital images, including downloads, are final and non-refundable.

   • Printed Products: If you receive damaged or defective printed products, please contact us within 7 days of receipt to arrange for a replacement. We do not offer refunds for printed products unless they are defective.

   • Satisfaction Guarantee: If you are not satisfied with your images, please contact us within 14 days of your reveal session. We will work with you to address your concerns and, if necessary, offer a re-shoot at no additional cost. Re-shoots are subject to availability and must be scheduled within 30 days of the original session.

6. Special Circumstances

   We understand that unforeseen circumstances may arise. In cases of extreme hardship or emergency, we may consider exceptions to our refund policy on a case-by-case basis. Please contact us to discuss your situation.
